Terms of Service (en)

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Maison, operated by Maison ("we," "us," or "the Service"), accessible at maisonre.app. By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use Maison. By using the Service, you represent that you are 18 or older, have the legal capacity to enter into contracts, and are not barred from receiving services under applicable law.

3. Description of Service

Maison is a real estate deal analysis tool that uses artificial intelligence to provide informational estimates including property values, renovation costs, investment scenarios, and deal recommendations. The Service is provided "as is" and "as available" for informational and educational purposes only. We make no guarantees about uptime, accuracy, or fitness for any particular purpose.

4. AI-Generated Content and Automated Decision-Making

You acknowledge and understand that: (a) Maison uses automated decision-making technology (ADMT), including large language models, computer vision models, and algorithmic valuation systems, to generate analysis; (b) AI-generated outputs may contain errors, biases, or inaccuracies that we cannot fully eliminate; (c) Maison does not constitute a Uniform Standards of Professional Appraisal Practice (USPAP)-compliant appraisal. Maison is an "opinion of value" tool and does not replace the work of a licensed appraiser, real estate broker, or other regulated professional; (d) You may request information about how our automated systems work by emailing hello@maisonre.app, in accordance with California Civil Code §1798.185 and the California Privacy Protection Agency's ADMT regulations effective January 1, 2026; (e) Maison is not designed to and does not make decisions on your behalf — it provides information to support your own decisions.

5. Not Financial, Legal, Tax, or Appraisal Advice

The Service does not provide financial, legal, tax, investment, or appraisal advice. Maison is not a licensed real estate broker, financial advisor, attorney, tax professional, certified appraiser, or investment adviser. Output from Maison is for informational purposes only. You should consult with qualified licensed professionals before making any real estate investment, loan, tax, or legal decision.

6. Data Accuracy and Third-Party Sources

Maison aggregates data from third-party sources including but not limited to MLS providers, public property records, listing aggregators (Zillow, Redfin, Realtor.com), property data APIs (Rentcast, ATTOM), and AI language models (Anthropic, OpenAI). While we strive for accuracy: (a) Real estate markets are dynamic and estimates may differ significantly from actual values; (b) Third-party data may contain errors, omissions, or delays; (c) Renovation estimates are projections based on aggregate data and may not reflect your specific property's actual costs; (d) Past performance does not guarantee future results. You are responsible for verifying all information independently before acting on it.

7. User Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information during signup, keep it current, and notify us immediately of any unauthorized account access. You are responsible for all activities under your account. We reserve the right to suspend accounts that show signs of unauthorized access, fraud, or security risk.

8. Acceptable Use

You agree not to: (a) Use the Service for any illegal purpose or to violate any laws; (b) Use Maison to engage in housing discrimination or any activity that violates the Fair Housing Act, the Equal Credit Opportunity Act, the California Fair Employment and Housing Act, or any other anti-discrimination law; (c) Attempt to reverse engineer, decompile, or extract the source code or underlying algorithms; (d) Use automated tools to scrape, copy, harvest, or systematically extract content; (e) Submit content that infringes intellectual property rights of others; (f) Share your account credentials with third parties; (g) Use the Service to make discriminatory decisions about lending, housing, insurance, or employment; (h) Misrepresent Maison output as a licensed appraisal, broker's price opinion, or other regulated valuation product.

9. Subscription, Billing, and Refunds

During the beta period, the Service may be provided free of charge. Once paid subscriptions are introduced: (a) Subscriptions renew automatically on your billing cycle unless cancelled at least 24 hours before renewal; (b) Fees are non-refundable except where required by law, except that we will issue a full refund within 7 days of initial subscription if you have not used the Service in that period; (c) Failed payments may result in downgrade to the free tier; (d) You may cancel at any time from your account settings; service continues through the end of your paid period; (e) Prices may change with 30 days' written notice.

10. Intellectual Property

All content, design, code, and intellectual property of Maison remains our exclusive property. You retain ownership of data you submit (addresses, photos, notes), but you grant us a worldwide, royalty-free license to use that data to provide and improve the Service. We do not sell your data to third parties. We may use de-identified, aggregated data to improve Maison's accuracy.

11. Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, abuse the Service, or engage in fraudulent activity. You may terminate your account at any time by emailing hello@maisonre.app. Upon termination, your data will be deleted within 30 days, except as required by law or for legitimate business purposes (fraud prevention, legal compliance).

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAISON IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR ACCURATE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAISON AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO FINANCIAL LOSSES ON REAL ESTATE TRANSACTIONS, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) $100, OR (B) THE AMOUNT YOU PAID TO MAISON IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Maison and its operators from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration in Riverside County, California, except that either party may seek injunctive relief in court for intellectual property violations. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Changes to Terms

We may update these Terms at any time. Material changes will be communicated via email and in-app notice at least 14 days before taking effect. Continued use of the Service after changes constitutes acceptance.

17. Severability and Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Maison.

1. Introduction

Maison ("we," "us," or "the Service") respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect personal information when you use Maison at maisonre.app. By using the Service, you agree to this policy. If you do not agree, please do not use Maison.

2. Information We Collect

We collect information in the categories below, depending on how you use the Service. Identifiers: Email address, name, IP address, and similar identifiers associated with your account or device. Account information: Investor type, approximate deal count, and operating cost preferences you provide (e.g., commission assumptions, financing preferences). Commercial information: Subscription tier (when introduced), transaction or billing-related history associated with your account. Property data you submit: Addresses, photos, listing URLs, notes, and other content you upload or enter for analysis. Analysis history and outcome feedback: Records of analyses you run and any outcome or accuracy feedback you choose to provide. Usage data: Features accessed, analyses run, and related product interaction data. Device and browser data: IP address, browser type, device identifiers where available, user agent, and language preference. What we do not collect: We do not intentionally collect precise geolocation, biometric data, race or ethnicity, religion, sexual orientation, health information, Social Security numbers, full payment card numbers stored on our systems (payment processors handle card data), or government identification numbers.

3. How We Use Your Information

We use personal information to: • Provide, operate, maintain, and improve the Service; • Personalize analysis using your stated operating costs and preferences; • Send transactional communications (e.g., welcome, billing, security alerts); • Track prediction accuracy and product quality using outcome feedback you provide; • Improve our AI models using de-identified and aggregated data where permitted; • Detect, prevent, and address fraud, abuse, and security issues; • Comply with law and enforce our terms.

4. Disclosure to Service Providers

We share personal information with service providers that process data on our behalf under written contracts that restrict their use of your information to providing services to us. Categories of providers include: • Supabase — database hosting and authentication infrastructure; • Vercel — frontend hosting; • Render — backend hosting; • Anthropic — AI analysis via Claude API; • OpenAI — photo and multimodal analysis where used; • Rentcast — property data API; • Stripe — payment processing (when introduced); • Resend — transactional email delivery.

5. Sale or Sharing of Personal Information

We do not sell your personal information and do not share it for cross-context behavioral advertising. We have not sold or shared personal information for those purposes in the past 12 months and have no plans to do so.

6. Your California Privacy Rights (CCPA / CPRA)

If you are a California resident, you may have the rights below under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), subject to exceptions under law: (a) Right to Know — Request disclosure of the categories and specific pieces of personal information we collect, use, disclose, or sell (we do not sell); (b) Right to Delete — Request deletion of your personal information, subject to legal exceptions; (c) Right to Correct — Request correction of inaccurate personal information; (d) Right to Opt-Out of Sale / Sharing — Maison does not sell or share personal information for behavioral advertising; you may confirm that status or submit preferences via the Your Privacy Choices page at /privacy-choices; (e) Right to Limit Use of Sensitive Personal Information — We do not use or disclose sensitive personal information for purposes that would trigger the CPRA limitation right in a way that applies to our current practices; (f) Right to Non-Discrimination — We will not deny goods or services, charge different prices, or provide a different level of service solely because you exercised privacy rights; (g) Right to Information About Automated Decision-Making — You may request meaningful information about the logic involved in our automated processing and the likely outcomes, including under regulations implementing California Civil Code §1798.185. To exercise these rights, email hello@maisonre.app. We will respond within 45 days (extendable by an additional 45 days where permitted). We verify requests using your email address and account details associated with your request.

7. Data Retention

• Active accounts: We retain personal information while your account remains active and as needed to provide the Service. • Deleted accounts: Personal data associated with your account is deleted within approximately 30 days of deletion, subject to legal exceptions. • Analysis records: Retained for up to 7 years for accuracy improvement and product analytics; after account deletion, records may be retained in de-identified or aggregated form where feasible. • Billing records: Retained as required by law (often up to 7 years for tax and accounting purposes). • Security logs: Retained for approximately 12 months unless a longer period is needed for security or legal compliance.

8. Data Security

We implement reasonable administrative, technical, and organizational safeguards, including encryption in transit (TLS), encryption at rest where supported by our infrastructure, access controls, and periodic security reviews. No method of transmission or storage is completely secure. If we determine that a breach requires notification under applicable law, we will notify affected individuals as required.

9. Children's Privacy

Maison is not directed at individuals under 18. We do not knowingly collect personal information from minors. If you believe a minor has provided us personal information, contact hello@maisonre.app and we will take appropriate steps to delete it.

10. Cookies and Tracking

We use minimal cookies and similar technologies for: • Authentication (session tokens); • Language preference; • Fraud prevention and security (e.g., device signals at sign-in). We do not use third-party advertising cookies, cross-site behavioral tracking pixels, or social media trackers for advertising on Maison. Most browsers let you control cookies; disabling authentication cookies may prevent you from signing in.

11. Global Privacy Control (GPC)

Where required by law, we treat Global Privacy Control (GPC) signals as valid requests to opt out of sale or sharing of personal information. Because we do not sell personal information or share it for cross-context behavioral advertising, GPC aligns with our practices by default.

12. International Users

Maison is hosted in the United States. If you access the Service from outside the United States, you consent to the transfer and processing of your information in the United States, which may have different data protection rules than your country.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email and in-app notice at least 14 days before they take effect where required. The "Last updated" date at the top will also change.

15. TEAM ACCESS AND USE POLICY

Maison is operated with strict internal controls over customer data. The following policy applies to all team members regardless of role or seniority: 1. Customer-submitted property data — including addresses, financial details, and analysis results — may not be used for personal real estate transactions by any team member, contractor, or affiliated party. 2. Customer analysis data may not be shared with external parties for the purpose of identifying investment opportunities, generating leads, or any commercial activity outside of Maison's stated services. 3. Administrative access to specific customer accounts is permitted only for legitimate operational purposes: customer support, fraud prevention, technical debugging, abuse investigation, and aggregate analytics. 4. All administrative access to identifiable customer data is logged and auditable. 5. This policy applies to all team members at all times and may not be waived. Violations result in immediate termination and forfeiture of any associated equity or compensation. 6. Customer data is never sold or shared with third parties for marketing, advertising, or commercial purposes. Customer data is used solely to deliver and improve Maison's services. Maison treats customer deal flow as confidential. The trust customers place in us by sharing their analysis is the foundation of the product, and we operate accordingly.

1. NOT AN APPRAISAL

Maison provides automated valuation estimates and deal analysis. Our output is an "opinion of value" tool, not a Uniform Standards of Professional Appraisal Practice (USPAP)-compliant appraisal. For loan underwriting, legal proceedings, tax appeals, or any purpose requiring a regulated appraisal, you must engage a licensed appraiser. Misrepresenting Maison output as an appraisal may violate federal and state laws.

2. NOT FINANCIAL OR INVESTMENT ADVICE

Maison is a research tool. It does not constitute financial, legal, tax, or investment advice. Real estate investment involves substantial risk, including risk of total loss. Past performance does not guarantee future results. You should consult licensed financial advisors, attorneys, real estate brokers, and tax professionals before making investment decisions.

3. DATA SOURCES MAY BE INACCURATE OR OUTDATED

Maison aggregates data from third-party sources including property records, listing aggregators (Zillow, Redfin, Realtor.com), and proprietary APIs. This data may contain errors, omissions, or delays. We make no warranties about data accuracy. You must independently verify all information before relying on it.

4. AI OUTPUTS MAY CONTAIN ERRORS

Maison uses artificial intelligence including large language models and computer vision. AI systems can produce hallucinated information, biased results, or factually incorrect outputs. We work to minimize these errors but cannot eliminate them entirely. Always cross-check critical numbers and recommendations.

5. RENOVATION ESTIMATES ARE PROJECTIONS

Our rehab estimates are based on aggregated market data and may not reflect your property's actual condition or cost. Always engage licensed contractors for accurate quotes before committing to a transaction. Unforeseen conditions discovered during construction routinely add 20–40% to estimated costs.

6. MARKET CONDITIONS CHANGE

Real estate markets are dynamic. Comparable sales data reflects historical transactions and may not predict future sale prices. Interest rate changes, economic conditions, local developments, and seasonal factors all affect property values in ways Maison cannot fully anticipate.

7. PERSONALIZATION DOES NOT GUARANTEE ACCURACY

If you've enabled personalized analysis using your operating costs (agent rates, financing, rehab strategy), these inputs reflect your stated assumptions. We do not verify them. Inaccurate inputs produce inaccurate analysis. Review the assumptions Maison uses on every deal.

8. FAIR HOUSING COMPLIANCE IS YOUR RESPONSIBILITY

Federal and state Fair Housing laws prohibit discrimination in real estate decisions based on protected classes including race, color, national origin, religion, sex, familial status, disability, and others. You are responsible for ensuring your use of Maison and any subsequent investment decisions comply with all applicable fair housing and anti-discrimination laws. Maison does not endorse or facilitate discriminatory practices.

9. VERIFY WITH LICENSED PROFESSIONALS

Before any real estate transaction, you should engage: • A licensed real estate agent or broker; • A licensed appraiser; • A real estate attorney; • A licensed home inspector; • A licensed contractor for rehab estimates; • A certified public accountant for tax implications. Maison is a tool to help you think through deals faster. It is not a substitute for professional advice.

10. YOUR USE IS AT YOUR OWN RISK

By using Maison, you accept full responsibility for any decisions you make based on its output. Maison and its operators are not liable for any losses, missed opportunities, or other damages arising from your use of the Service.

9. Suscripción, facturación y reembolsos

Durante la beta el Servicio puede ser gratuito. Con suscripciones de pago: (a) las suscripciones se renuevan automáticamente salvo cancelación con 24 horas de anticipación; (b) las tarifas no son reembolsables salvo donde la ley lo exija; reembolso completo dentro de 7 días si no usó el Servicio; (c) pagos fallidos pueden degradar al nivel gratuito; (d) puede cancelar en configuración; el servicio continúa hasta el fin del periodo pagado; (e) los precios pueden cambiar con aviso por escrito de 30 días.

10. Propiedad intelectual

15. Ley aplicable y resolución de disputas

Estos Términos se rigen por las leyes del Estado de California. Las disputas se resolverán por arbitraje vinculante en el condado de Riverside, California, salvo medidas cautelares por propiedad intelectual en tribunales. Renuncia a acciones colectivas o arbitraje colectivo.

10. 使用风险自负

使用 Maison 即表示您对其输出所作任何决定承担全部责任。Maison 及其运营方不对因您使用本服务而产生的任何损失、错失机会或其他损害承担责任。
